    商品房逾期交房责任应如何界定

    《民法典》第五百六十三条

     

      有下列情形之一的,当事人可以解除合同:

      (一)因不可抗力致使不能实现合同目的;

      (二)在履行期限届满前,当事人一方明确表示或者以自己的行为表明不履行主要债务;

      (三)当事人一方迟延履行主要债务,经催告后在合理期限内仍未履行;

      (四)当事人一方迟延履行债务或者有其他违约行为致使不能实现合同目的;

      (五)法律规定的其他情形。

      以持续履行的债务为内容的不定期合同,当事人可以随时解除合同,但是应当在合理期限之前通知对方。

      

    第五百七十七条

     

      当事人一方不履行合同义务或者履行合同义务不符合约定的,应当承担继续履行、采取补救措施或者赔偿损失等违约责任。

      

    商品房逾期交房赔付标准

     

      商品房逾期交房赔付标准是指房地产开发商向购房者承诺开发商品房的交付期限,如果开发商不能在协议约定的交房期限内交付购房者房屋,那么开发商需要按照一定的标准进行赔付。

    Article 563 of the Civil Code

     

      The parties may terminate the contract under any of the following circumstances:

      (3) One of the parties delays the performance of major debts, and fails to perform within a reasonable period after being urged;

      (5) Other circumstances prescribed by law.

      For a non-term contract with continuous performance of the debt as the content, the parties may terminate the contract at any time, but they shall notify the other party before a reasonable time limit.

      

    Article 577

     

      If one of the parties fails to perform the contractual obligations or the performance of the contractual obligations does not conform to the agreement, it shall be liable for breach of contract such as continuing to perform, taking remedial measures or compensating for losses.
